Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://www.beefupbeefjerky.co.il website (the “Service”) operated by Beef Up beef jerky (“us”, “we”, or “our”). 

Familiarize yourself with our policies and know what they are ahead of placing an order. The information contained herein is important for us as the operators of the site and for you the consumer. 

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you do agree with any part of these terms then you may not access the Service.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Beef Up beef jerky and its licensors.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Beef Up! beef jerky.

Beef Up! beef jerky has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Beef Up! beef jerky shall not be responsible for or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Governing Law

 

These Terms shall be governed and construed in accordance with the laws of Israel without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Delivery Terms

When placing an order, you currently have 2 delivery option to choose from. The first, is “Door to Door” service to any address that you provide at 50nis. The second option is “local pickup” for 25nis it is cheaper and, in some cases, more convenient because they offer longer working hours. The address shall be within Israel’s borders and must adhere to the delivery locations provided upon checkout on our site only.

However, please be advised that there may be instances where delivery options may appear to be available and could even appear on the delivery company’s map, when in reality the package may not be able to be delivered there, this can be caused by human error or map locations that have not been updated yet by the delivery service. This can be the case for certain Yishuvim, for example.  

In such cases where a customer needs delivery to a location or Yishuv that is not serviced, please contact us here and we will try to help you find another delivery option. We do not guarantee any such delivery options or services to be available.

Beef Up! beef jerky reserves the right to change its delivery locations and/or fees without giving any prior notice. 

Fees

The current standard delivery fee is 25-50 nis across the country for packages up to 3 kg.

The above fees only apply to standard deliveries and does not include same day delivery, returns, packages that exceed 3 kg, extra-long distances, locations beyond the green lines, and Yishuvim.

Any delivery options outside the scope of standard delivery, is considered a “Special delivery” and will be treated as such. Special deliveries are subject to extra charges, and prolonged wait times, in the event that they can even be delivered to the location .

Delivery Times

Packages will be delivered to the address provided within 2-5 business days, under standard delivery conditions. “Special Deliveries” can take 5-7 business days or longer to arrive as these are usually locations which tend to be beyond the green lines and/or long distances.

In the event of natural disasters, terrorist attacks etc. there could be delivery delays that are out of our control. We will not be held liable for such delays in case of such events. 

Orders that have been placed Sunday-Thursday after 1 pm will be considered as if they were placed the following day.

Orders that have been placed on Thursday after 1pm through Sunday before 1pm will be considered as if they were placed on Sunday, and therefore delivery times should be calculated accordingly.

If a delivery has been scheduled with the customer, and upon delivery the customer is not present at the address provided at the time that has been agreed upon, the package will be returned to us. In such cases a “re-delivery” charge will apply and be paid by the customer, even if the order was initially qualified for “free delivery”.

In case of a failed attempt to contact the customer through the information provided to us within 3 days of placing the order, we reserve the right to cancel the order and customer will not be charged for the items. However, there will be a 14.90 restocking, handling, packaging and labor fee as well as a credit card cancellation fee + any other expenses which our company may have incurred. In such cases we reserve the right to discontinue, suspend or block any future services to this customer.

Cancelation/Return Policy

We are Beef Up! a company that produces a ready to eat, packaged, dried meat snack called beef jerky.

Please know what you are buying before placing an order. Returns will not be accepted based on arguments such as “I thought I was buying Biltong” or “its to chewy” or “salty”, or “spicy” etc.

Return/Exchange policy is as follows:

1. It is the customers responsibility to immediately open the package and inspect the items to make sure that the items match the receipt and that they got what they paid for. If there is any issue with the order, please contact us here and notify us immediately. If a legitimate claim is made, or an error has occurred on our end, we will do our best to correct the situation.

2. The customer has the right to return the items within 14 days from the date of purchase, along with the original purchase receipt showing the date, time, method of payment and product description. The items must be new and in their original vacuum packaging, unopened, unused, not damaged and not tampered with; Returns will NOT be accepted without a receipt, or past the two week mark since the purchase was made.

3. Changes or Cancelation are done by phone ONLY.

4. Changes that need to be made to an order are subject to our company’s approval first, and a decision will be made at our sole discretion as we see fit. 

5. We reserve the right to refuse or cancel an order, for any reason, at any time, as we see fit at our sole discretion; without having to give any prior notice, reason, or explanation. In such cases, the order confirmation that has been sent out to the customer through our site, will be null and void and shall have no legal standing. 

6. We notify customers of order cancelations by means of an SMS, WhatsApp or Email message. Customers shall not have any complaints towards our company, nor will they be entitled to or eligible to receive any form of compensation.

7. A customer has the right to cancel an order within 24 hours and will not be charged for any items. In case that the customer has already been charged we will issue a full refund. This is when a package has not been dispatched for delivery. Please allow up to 5 working days to see the refund on your bank statements.

8. If a package has already gone out for delivery and a customer wishes to cancel or return the order after receiving the package, it is the customers responsibility to return the package to us with the full contents of the order and not just a part thereof. The items shall be in their new and original vacuum sealed package, unopened, unused, not damaged, and have not been tampered with. 

9. When sending or returning a package back to us, the customer can request to use our “return service delivery” at their own expense, for the sole purpose of returning our merchandise back to us; and shall in no way be interpreted as a waiver of our rights. We offer this service as a convenience to the customer, subject to our company’s approval as well as the delivery company’s terms, and at the rate that they will quote.

10. After our company has received the return package by the customer, we will carefully inspect the product, to make sure that it is fully intact, in its original vacuum sealed packaging, when they are new, unopened, unused, not damaged and have not been tampered with, before a refund can be issued; minus a 14.90 nis restocking/handling/packaging/labor fee as well as a 5% credit card transaction cancellation fee for locally issued cards or 7% for foreign credit cards.

11. If any part of the returned items is found to not be in its original vacuum sealed new condition; or it has been opened, used or otherwise damaged in any way, the customer will not receive a refund and will be charged for the unsellable items. Statements such as “That’s how I received it” will not be accepted”.

12. In any case, our company will not incur any financial loss resulting from a customer’s desire to cancel or send back an order and will be charged any/all additional fees stated herein.

13. The product leaves our company after it’s been carefully inspected for QC, professionally packaged, vacuum sealed and free of any damage. Please be aware that this is a perishable item that cannot be returned under any circumstances, except under those conditions specified in article 2 or in the rest of the guidelines of these terms and conditions subject to approval.

Credit Card Terms

  1. Orders shall be placed by individuals 21 years of age or older and whose name appears on the credit card that is being used at the time of the purchase, accompanied by a T.Z. or passport number that has been issued to them.
  2. Foreign credit cards that have been issued abroad are subject to an additional 3.5% transaction fee per order. In case of returned items there will be a 7% transaction cancelation fee in addition to 14.90 restocking/handling/packaging/labor fee. 
  3. For Israeli credit cards issued locally, a 5.0% transaction fee will be charged only in cases of returned packages in addition to 14.90 restocking/handling/packaging/labor fee and 7% transaction fee for foreign cards.     

In case we identify a customer involved in illegal activities on our site directly or indirectly through fraudulent credit card use or by any other means, we will immediately terminate this account and hand over any/all information that we have in our possession to the proper law authorities for further investigation. We will also legally pursue and/or sue the said individual(s) involved for any harm, losses, or damages that were caused or inflicted on us, directly or indirectly, to the full extent of the law as a result of his/her/they/their actions.
